The Italian government has taken the first step towards infringement proceedings against Austria with a “formal notification letter” to the European Commission (EC).
The Italian lawsuit is directed against Austria’s 2021 anti-crossing measures along the Brenner Pass, which include a sectoral driving ban, a night driving ban, a winter driving ban, and the removal of blocks.
These measures led to traffic jams of up to 70 kilometers and rear-end collisions in the Tyrol region.
The International Road Transport Union said, “The traffic is unbearable and the situations endanger traffic.” This has been exacerbated by the construction of the Brenner Tunnel, which will not be completed until 2033.
Many EU road freight stakeholders have opposed Austria’s “several illegal anti-transit measures”, claiming they prohibit the free movement of goods in the EU.
The International Road Transport Union (IRU) and 12 European road transport associations It has been written to the European Commission several times. They demand action, but to no avail. The Commission held discussions with Italy, Germany and Austria in 2023, but no agreement was reached.
As a result, in October 2023 the Italian government announced plans to file a lawsuit against Austria, Activation of Article 259 of the European Union.

The 448-kilometre-long Brenner Pass, from Verona to Munich, is a major transport route connecting passengers and goods between Austria, Germany and Italy.
